These Terms of Use (the “Terms”) govern your use of and access to www.beccafrancis.com and its sub-domains and affiliated sites, as well as the Becca Francis pages and accounts on Facebook®, Instagram®, LinkedIn®, YouTube® and other online platforms (the “Sites”). The Sites are operated by Becca by Human Design Pty Ltd ABN 72 687 898 826 trading as Becca Francis (“Becca Francis”, “my”, “me” or “I”).

Please read both these Terms and my Privacy Policy carefully, which is incorporated into these Terms. By using any or all of the Sites, you accept and agree to be bound by these Terms. If you do not want to agree to be bound by these Terms, do not use the Sites.

If you buy a digital product, course, tool or resource from me, including my AI tool Clair, your Psychic Practice Coach, your purchase is governed by my Digital Product Terms and Conditions at www.beccafrancis.com/digital-products-terms-conditions. If anything in these Terms conflicts with those terms for a purchase, the Digital Product Terms and Conditions apply.

I may modify these Terms from time to time, and any modifications will be effective when I post them. All changes I make will be reflected in the date at the top of the document. Your continued use of a Site following any changes means you accept those changes. For your convenience and future reference, the date of the most recent revision of these Terms is listed above.

SITE CONTENT.

Becca by Human Design Pty Ltd owns and controls the Sites, which provide information about my products and services and may, from time to time, provide access to educational materials. You agree that use of or access to any or all of the Sites does not, standing alone, create any sort of representation or future promise. The unauthorised reproduction, use or copying of any content on the Sites, written, photographic or otherwise, is not permitted. If you use my content without permission, I may ask you to remove it and take any other action available to me under the law.

INTELLECTUAL PROPERTY.

Unless explicitly stated otherwise, as between you and Becca by Human Design Pty Ltd, Becca by Human Design Pty Ltd owns all right, title and interest in and to the Sites, including, without limitation, graphics, site content, design, organisation, compilation and other matters related to or included on the Sites. My name, Becca Francis, and all related names, product and service names, characters (including Clair), logos, slogans and designs are my trademarks, and you may not use these marks without my prior written permission. All other names, logos, product and service names, designs and slogans on the Sites are the trademarks of their respective owners and should not be used without those owners’ permission. You are granted a non-exclusive, non-transferable, revocable licence to access and use the Sites and the free resources available for download from them, strictly in accordance with these Terms.

THIRD PARTY RIGHTS.

Content and materials posted to the Sites may be the copyrighted content of others (“Third Party Content”) that I use with permission or as otherwise permitted by copyright law. I respect the intellectual property of others and ask that you do the same. You must obtain permission from the owners of any Third Party Content before copying, distributing or otherwise using those materials. Except as otherwise permitted by copyright law, no copying, redistribution, retransmission, publication or commercial use of downloaded material is permitted without the express permission of the copyright owner.

If you believe that your work has been copied on one or more of the Sites in a way that constitutes copyright infringement or otherwise violates your intellectual property rights, please contact me at the email address listed below and provide the following: (i) identification of what is claimed to have been infringed; (ii) identification of what is claimed to be infringing; (iii) your contact information (or the contact information of the person we need to contact about the infringement); (iv) a statement that the person submitting the complaint is doing so with a good faith belief that use of the material in the manner complained of is not authorised by the owner, its agent or the law; (v) a statement that the information provided is accurate; (vi) a physical or electronic signature of the person submitting the complaint; and (vii) if that person is not the owner of the content at issue, a statement that the person submitting the complaint is authorised to act on the owner’s behalf.

LINKING TO OUR SITES.

Anyone linking to the Sites must comply with all applicable laws and must not: (i) misrepresent their relationship with Becca by Human Design Pty Ltd or Becca Francis; (ii) present false or misleading information about Becca by Human Design Pty Ltd or Becca Francis; or (iii) contain content that is reasonably considered profane, offensive, defamatory, vulgar or unlawful.

ADVERTISEMENTS AND LINKS.

I may at times include advertisements on the Sites. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Sites are solely between you and that advertiser. Any opinions, advice, statements, services, offers or other information or content expressed or made available by advertisers, including information providers, or any other end users are those of the respective authors and not my own. To the extent permitted by law, I am not responsible for any loss or damage you suffer as a result of those dealings. Any affiliate links on the Sites will be clearly marked, and you are welcome to contact me with any questions about affiliate links.

You may find links to other websites on a Site. These links are provided solely as a convenience to you and are not an endorsement of the contents of those third party sites, and I make no representations about the content or accuracy of materials on them. To the extent permitted by law, I am not responsible for any damage or loss caused by or in connection with your use of or reliance on any content, goods or products available on or through any linked site. DISCLAIMER AND LIMITATION OF LIABILITY.

The free content on the Sites is provided for general information, education and personal development. It is not medical, mental health, legal, financial or other professional advice, and it does not replace advice from a qualified professional about your circumstances. Psychic development and intuitive practice experiences are individual, and results are not guaranteed.

I take reasonable care with the Sites, but I do not guarantee that they will always be available, uninterrupted or error-free, or that all information on them is complete or up to date. Please use caution, discretion and common sense when using the Sites.

To the extent permitted by law, I am not liable for any indirect or consequential loss arising from your use of, or inability to access, the free content on the Sites.

Your consumer rights. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other consumer protection law that applies to you and cannot legally be excluded. Where my liability for a breach of a consumer guarantee can lawfully be limited, it is limited to resupplying the service or paying the cost of having it resupplied. CHOICE OF LAW.

These Terms are governed by the laws of the State of Queensland, Australia, subject to any mandatory consumer protection laws that apply where you live. You and I agree to submit to the non-exclusive jurisdiction of the courts of Queensland, Australia. Nothing in this clause stops you from using any court, tribunal, regulator or consumer-law remedy that is available to you where you live.
